In a striking instance of betrayal, a judge has sentenced Sean Higgins, aged 74 from Ballinvana, Kilmallock, to prison for exploiting an elderly lady’s trust nearly two decades ago. Higgins had deceived her into parting with her life savings, with no clear evidence that she ever recovered her money, highlighting a severe breach of trust and irresponsible financial misconduct.
Judge Colin Daly described Higgins’ actions as profoundly egregious, emphasizing how he deliberately exploited his position of authority when advising her on her investments and bank management. This betrayal of trust is what makes this case particularly upsetting.
In 2007, the victim, whose name remains confidential, invested €73,722.66 with Higgins. Court proceedings revealed that Higgins diverted €50,000 into his own bank account and transferred €23,722.66 into a luxury car business named H&H Imports Ltd, which involved his son. Recognizing the severity of the case, authorities confirmed that only €5,000 had so far been recovered.
Higgins pleaded guilty to a charge under the Criminal Justice (Theft and Fraud Offences) Act of 2001, admitting to actions that involved gaining a financial benefit through deception.
During the sentencing hearing in June, prosecutor Lily Buckley, with support from Sergeant David Higgins, laid out the evidence that painted a stark picture of betrayal. The victim shared her emotional impact in a heartfelt statement, revealing that the entire ordeal has caused her significant distress, sleepless nights, and ongoing worry. She expressed her deep regret at trusting Higgins and lamented that she could have earned much more had she kept her money in a bank account.
Her words echoed her desire to move on, emphasizing her wish to sever all ties with Higgins and forget the event entirely. Her suffering highlights the devastating real-world consequences that financial scams against the elderly can inflict.
Judge Daly noted that Higgins had been making empty promises of repayment for nearly 20 years. He granted Higgins until November to make restitution, warning that time was running out. Recently, Higgins’s lawyer, Lorcan Connolly SC, informed the court that Higgins did not have funds to pay restitution at the moment.
The judge emphasized that Higgins falsely told the victim he was a qualified accountant, a claim he has no credentials for. Instead, he used her hard-earned savings to fund personal investments and a family business, which eventually failed. This was not an impulsive act but a carefully planned deception involving sophisticated manipulation to prolong his scheme, even when he knew the money was gone.
A handwritten agreement to sell property to his grandson, which was introduced as evidence, also failed to materialize, further illustrating how Higgins’ promises to make amends were hollow.
While the judge acknowledged that Higgins might feel remorse, he criticized the sincerity of his apologies, noting that the victim has suffered a significant financial loss with little hope of recovery.
